Agreement and Acknowledgement
This Privacy Policy ("policy" or "terms" or "conditions") is an Agreement ("Agreement") between you ("you") and Falcon Shamanic Healing & Magick LLC ("us", "we", or the "Company"), a California limited liability company.
This policy applies to your use of the Company website at https://www.psychicexperiment.org/ (the "Site") and to your communications with the Company, including any information (the "data" or "the data" or "your data") you intentionally or unintentionally convey, transmit, send, or submit to the Company or to the Site in any form and by any means.
By accessing or using the Site, communicating with us, or submitting data to us, you acknowledge that you have read and understand this Agreement, and you accept and agree to its terms and conditions in their entirety.
For further details on using our Site, please refer to our Terms of Use and our Experiment Agreement. By using the Company's Site or by submitting your data, you agree to be bound by the Company's Terms of Use (available on the Internet at https://www.psychicexperiment.org/terms_of_use/) and the Company's Experiment Agreement (available on the Internet at https://www.psychicexperiment.org/agreement/), which are both expressly incorporated into this Agreement by this reference.
Data We Collect
When you visit our Site, the Company collects technical and usage information about you and your computer such as your IP address, your computer's general geographical location (which is derived from your IP address), your web browser details, the web pages you visit on the Site, and how long you spend visiting each page (collectively, "telemetry" or "telemetry data"). The telemetry data is collected to analyze how you interact with the Site as part of our paranormal study, and also so we can better serve you by understanding your Site interactions.
In the course of participating in our psychic experiment, you'll be asked to submit data to us electronically that includes your first name and email address, answers to study questions, freeform text, pictures, or photos, and all such data we collect will be stored and managed subject to this Agreement.
We will not intentionally collect information about non-Company websites you visit.
Data Privacy, Security, and Data Sharing
As part of our study, we collect your first name and email address so we can communicate with you. We value your privacy, and protect names and email addresses using industry standard security that includes access controls and in-transit and at-rest encryption. We do not sell email addresses or other personally identifiable data (PII).
Psychic impressions you provide during the study, including text you write and pictures you draw, will be shown to a panel of independent judges who will determine if your impressions match the psychic targets you were aiming for. The judges will not be shown your name and email address you used when signing up, but if you include information in your impression text or pictures that identifies you (such as your name, email address, a picture of you, etc.), then judges may be able to discern your identity. By participating in the study, you accept this risk, and permit us to show the judges your impressions so they can be independently judged.
Like many organizations, we use third-party partners such as Google and Cloudinary to manage our computing infrastructure and data storage. Data you submit or that we collect will be stored in databases managed by these partners. While we have confirmed that these partners claim to employ industry-standard security and manage data responsibly in accordance with applicable privacy laws, you agree that we cannot control, nor be held liable for, how our partners use data (including your data) that is stored in their environments.
To the best of our knowledge, our infrastructure partners (including Google and Cloudinary) store our data within the United States.
If you exchange emails with us, connect to us via the Internet, call us on the phone, or submit your data to the Site, you understand that such communications may travel across local, state, national, and international boundaries, and while it is in transit, it may be stored, intercepted, scrutinized, or abused by Internet Service Providers, government agencies, or other third parties, all of which are outside of the Company's responsibility and control, and for which you agree to hold Company harmless in all cases.
We may be required to release information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state or federal laws or respond to a court order, subpoena, law enforcement or regulatory request, or search warrant. We reserve the right to collect and share any information: (i) in order to investigate, prevent, or take action regarding suspected or actual illegal activities; (ii) as appropriate or necessary to enforce our Terms of Use or investigate potential or actual violations of the Terms of Use or Privacy Policy; (iii) take precautions against liability; (iv) to protect the security or integrity of our Site and services; (v) to exercise or protect our rights and property, our Site, our services, or the rights and personal safety of Company affiliates, users, or others; or (vi) for other legitimate purposes.
You agree not to email, upload, post, or transmit any information to us that you consider sensitive or confidential unless you have taken steps to ensure that your data is secured in transit, which is wholly your responsibility, and you agree to hold the Company harmless if your data is intercepted, lost, stolen, exploited, or published.
By participating in the study, and subject to this Agreement, you expressly permit us to (i) email you a copy of your personal results from the experiment, and (ii) share your name and email address with Amazon in order to send you a gift card, provided that you are one of the three randomly selected gift card winners.
Liability Waiver
You assume the risk of any and all damage or loss incurred as a result of your use of the Site and your participation in the study and our use of your data, and you agree to hold harmless, to the fullest extent allowed by law, the Company and its owners, officers, scientists, judges, and employees from and against all claims, demands, suits, actions, payments, liabilities, judgments and expenses (including attorneys' fees) arising out of or resulting from the acts or omissions of the Company and its owners, officers, scientists, judges, or employees related to (i) the performance this Agreement, (ii) the operation or contents of the Site, (iii) the operation of the study or the contents of its resulting publications, (iv) the written or oral or electronic communications by you or us, and (v) the safeguarding of your data by us or our vendors. Liability includes any claims, damages, losses, and expenses arising out of or resulting from any service we offer or the contents of the Site or the execution of this Agreement and that results in any claim for damage whatsoever including, but not limited to, any exposure or theft or misuse of your data or information you provide and any damages or injury resulting therefrom.
Other Sites
The Site and communications to you from the Company may contain web links to other websites which may collect their own data about you, and your use of those sites will be governed by their terms of use and privacy policies that may differ from the Company's policy, and you agree to hold the Company harmless for the content of, and any data collected by, those other websites.
Cookies & Tracking
The Company stores information in cookies (temporary files stored on your computer) in order to keep track of your unique experiment session as you navigate through the Site. Information stored in cookies, if important to Company, is always encrypted using an industry-standard encryption algorithm in order to help protect your data from third parties.
You can clear cookies from your browser, or disable cookies altogether. However, if you choose not to accept cookies in your web browser, the Site will not function properly, so you will be unable to participate in the study.
Like most websites, the Site may make use of tracking pixels, cookies, or APIs (collectively, "trackers"), which are small bits of programming code designed to help us understand who is visiting the Site, how the Site is navigated, and how best to attract additional visitors to the Site. Trackers may collect telemetry data on their own. We may also provide data to trackers so they function properly, with such data including, but not limited to, your IP address, pages you visited, and a hashed version of your email address (that is, a shortened "fingerprint" representing your email address, rather than your email address itself). We may use trackers provided and managed by Google, Facebook, or other vendors who collect data from the trackers so we can use it to improve our Site and marketing. We also use fonts downloaded to your browser from Google, which may allow Google to collect certain information from your browser, such as your IP address. You agree that data collected by these third-parties via their trackers, APIs, fonts, and other technologies is purely the responsibility of those third-parties, and subject to their privacy policies.
You agree we may share telemetry and other data with third parties, subcontractors, and partners contracted to provide services on our behalf. Categories of these services include Internet and hosting services, gift card provisioning services such as Amazon, website monitoring and tracking services, data analytics services, security testing services, and marketing and communications services. We may also share such information with government agencies when required to do so under U.S. law.
Data Retention
Because the Site involves a study whose results we intend to publish, the Company reserves the right to permanently retain data it collects or that you submit, except where otherwise noted in this policy or prohibited by law, and all such data retained will be subject to the terms of this Policy.

Note that the integrity of the data we collect is critical to our scientific study. By "integrity," we mean that data is protected against changes during and after the study, and also, that the data is not revealed publicly prior to the study's formal publication, so that one person's experimental results do not affect another person's results, or the judging of results.
Therefore, by participating in the study, you agree that your exercise of your rights are subject to the study's "Informed Consent Agreement for a Psychic Experiment" that you accepted when you started the study, and which sets certain restrictions on your rights. If you opt out of marketing communications, note that we still reserve the right to email you in relation to the servicing of (i) your account, (ii) our relationship, (iii) any requests you make, and (iv) any legal or privacy-related activity.
California Consumer Privacy Act (CCPA) Disclosures
The California Consumer Privacy Act of 2018 (CCPA) requires the Company to provide additional privacy-related information to residents of California.
At the time of this writing, the Site and any services we provide are not required to comply with CCPA, a law which applies only to companies that have a gross annual revenue of over $25 million; buy, receive, or sell the personal information of 50,000 or more California residents, households, or devices; or derive 50% or more of their annual revenue from selling California residents' personal information. If this situation changes, this notice will be updated.
Governing Law
You agree that all claims arising out of or relating to our Site or services we provide or this Agreement will be governed by California law, excluding California's conflict of laws rules, and will be litigated exclusively in the federal or state courts of Los Angeles County, California, USA.
Updates
Changes to this policy will become effective on the date they are posted on the Site at https://www.psychicexperiment.org/privacy_policy/. We reserve the right to change this policy at any time and from time to time in our sole and absolute discretion without the duty to notify you. Changes, modifications, additions, or deletions will be effective immediately on their posting to the Site. You should check this policy periodically as its terms may change from time to time without prior notice to you. Your continued use of the Site after we post any such modifications will constitute your acknowledgment of the modified policy and your agreement to abide and be bound by it. We will also revise the "last updated" date found at the beginning of this document when we post changes to it.
Severability
If any part of this policy is held or made invalid by a court decision, statute, rule, or otherwise, the remainder of this policy shall not be affected thereby.
