Agreement and Acknowledgement

These Terms of Use ("terms" or "conditions" or "Terms of Use" or "policy") is an Agreement ("Agreement") between you ("you") and Falcon Shamanic Healing & Magick LLC ("us", "we", or the "Company"), a California limited liability company.

This policy applies to (i) your use of the Company website ("Site"), and (ii) to any information you transmit, send, or submit to the Company or its Site in any form and by any means ("data" or "your data" or "the data"). By accessing or using the Site or by submitting your data to us (the "Services"), you acknowledge that you have read and understand this Agreement, and you accept and agree to its terms and conditions.

By using the Company's Services or Site, or by submitting your data, you agree to be bound by the Company's Privacy Policy (available on the Internet at https://www.psychicexperiment.org/privacy_policy/) that is expressly incorporated into this Agreement by this reference.

No Warranties

By using the Site, you agree that its contents are provided "as is" without warranty of any kind, expressed or implied. You agree that under no circumstances shall the Company or its representatives be liable for any incidental, special, or consequential damages that result from the use, or inability to use, the content of the Site, or that result from the handling, storage, or use of data you send us. You agree that your use of the Site and its contents are strictly at your own risk, and that we make no guarantee regarding the safety, security, confidentiality, or integrity of data you send us.

To the maximum extent permitted by applicable law, the Company assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content provided by or in relationship to the Site; (ii) any unauthorized access to or use of our servers and/or any and all personal information stored therein; (iii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site, including any purchases made therein or advice received therefrom; (iv) any interruption or cessation of transmission to or from the Site; (v) any bugs, viruses, worms, trojan horses, ransomware, malware, or the like that may be transmitted to or through the Site by any third party; (vi) Site content that is inaccurate, incorrect, or outdated. In no event shall the Company, its Affiliate entities, owners, officers, directors, employers, agents or licensors be liable to you for any claims, proceedings liabilities, obligations, damages, losses or costs in an amount exceeding the amount you paid to the Company hereunder.

This limitation of liability section shall apply regardless of whether the alleged damages arise out of breach of contract, tort, or any other legal theory or form of action, even if the Company has been advised of the possibility of such damage.

No Reimbursement

We are unable to reimburse you for any fees, charges, fines, or other debts you incur for any purpose, including, but not limited to, fees for texting, telecom services, driving, mailing, shipping, handling, or delivery. If you send us any text messages, mail, or shipments, or incur any other charges or debts of any kind, you understand that you will be solely responsible for paying those without reimbursement from us.

Restrictions

You agree not to use any automated systems, including, without limitation, "robots," "spiders," "web crawlers," "screen scrapers," "page scrapers," "offline readers," "bot" or "Denial of Service" (DoS) traffic generators, automated scripts that fill out our web forms, or similar tools that access the Site in a manner that sends more request messages to our network than a human can reasonably produce in the same period of time by using a conventional online web browser. You will not attempt to gain unauthorized access to any non-public part or feature of the Site or the Company's networks by hacking, password mining or guessing, or other means that are illegal or not officially permitted in writing by the Company, nor perform security scanning or penetration testing of the Site without permission from the Company. You agree not to frame the Site in browser frames, or otherwise alter or reroute content from the Site en route to a visitor's browser. You agree not to impersonate Company employees, contractors, subcontractors, or partners in any electronic message. Appropriate legal action will be taken for any illegal or unauthorized use of the Site.

Sole Control of Site

You agree that the Company is permitted to limit or even prohibit your access to the Site and its features for any reason at the Company's sole discretion, at any time, and without notifying you.

Copyright and Permission to Use

Except where otherwise noted, all writing and graphics published on the Site are Copyright 2022 Falcon Shamanic Healing & Magick LLC, All Rights Reserved. You have permission to quote short passages of any writing on the Site for academic writing or journalism, provided that you cite Scotch Wichmann as the author. If you quote any content from the Site, you agree that the article, book, posting, film, broadcast, show, or other material where the quoted content appears may be promoted on the Site or other locations, including a screenshot, photograph, or other audiovisual footage of the material where the quoted content appears, without renumeration to you or your publisher, in perpetuity.

If you post or transmit text or images ("Commentary") on or through the Site, you agree that the Site and the Company may use your Commentary for any purpose, including republication of your Commentary elsewhere digitally or in print, and without remuneration of any kind to you, in perpetuity.

All rights not expressly licensed to you are reserved to the Company.

Governing Law

You agree that all claims arising out of or relating to our Services and this Agreement will be governed by California law, excluding California's conflict of laws rules, and will be litigated exclusively in the federal or state courts of Los Angeles County, California, USA.

Updates

Changes to this policy will become effective on the date they are posted on the Site at https://www.psychicexperiment.org/terms_of_use/. We reserve the right to change this policy at any time and from time to time in our sole and absolute discretion without the duty to notify you. Changes, modifications, additions, or deletions will be effective immediately on their posting to the Site. You should check this policy periodically as its terms may change from time to time without prior notice to you. Your continued use of the Site after we post any such modifications will constitute your acknowledgment of the modified policy and your agreement to abide and be bound by it. We will also revise the "last updated" date found at the beginning of this document when we post changes to it.

Severability

If any part of this Agreement is held or made invalid by a court decision, statute, rule, or otherwise, the remainder of this Agreement shall not be affected thereby.
